Mediation is an excellent alternative to the traditional adversarial trial that is the basis of our court system today. Unlike a trial, mediation allows the parties to tackle their own issues working together, instead of having some random stranger in a funny black shirt decide how to solve a problem he or she may never heard of before that day.
In this alternative dispute resolution model, the parties to the conflict, as well as their attorneys if they have been retained, are guided by a completely neutral third party – the mediator – who helps them explore options to the problems at hand. The mediator is not a judge or arbitrator; he or she does not render decisions. The mediator acts as a facilitator, a go-between for the parties whose purpose is to help the parties understand one another’s interests more clearly. The mediator’s ultimate goal is to help the parties develop their own solution to their conflict wherein both parties are equally satisfied with the outcome.
I am a true believer in this method of dispute resolution have put forth
a great deal of effort to become a better mediator. If you are interested
